1. Acceptance of Terms

By accessing or using the Afters platform ("Platform"), operated by Afters, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Afters is a technology platform that connects prospective cosmetic surgery patients with licensed medical practitioners. The Platform enables patients to browse before & after photographs, submit consultation requests, and receive personalized video consultations and quotes from participating practices.

Afters does not provide medical advice, diagnosis, or treatment. All medical services are provided by independent, licensed healthcare professionals. The Platform serves solely as a communication and discovery tool.

3. User Accounts

To access certain features of the Platform, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Patient Users

As a patient user, you understand and agree that:

  • Information provided through the Platform, including video consultations and quotes, is for informational purposes and does not constitute medical advice
  • You should consult with a qualified healthcare professional before making any medical decisions
  • Before & after photographs represent individual results and outcomes may vary
  • Pricing information provided through the Platform is an estimate and may change upon in-person evaluation
  • You are responsible for the accuracy of information you submit, including photographs and medical history

5. Practice Users

As a participating practice, you represent and warrant that:

  • All practitioners listed are properly licensed and credentialed in their respective jurisdictions
  • Before & after photographs are authentic, unaltered representations of actual patient results
  • You have obtained all necessary patient consents for photographs shared on the Platform
  • Quotes and information provided to patients are accurate and provided in good faith
  • You will comply with all applicable laws, regulations, and professional standards

6. Fees and Payment

Patients can browse the Platform and receive consultations at no cost. Practice users agree to pay applicable fees as outlined in their service agreement with Afters. Fee structures, including per-accepted-request charges, are detailed in the practice dashboard and may be updated with reasonable notice.

7. Intellectual Property

The Platform, including its design, features, and content (excluding user-generated content), is owned by Afters, Inc. and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent.

By uploading content to the Platform, you grant Afters a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the operation of the Platform.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Upload false, misleading, or deceptive content
  • Impersonate any person or entity
  • Interfere with or disrupt the Platform or its servers
  • Attempt to gain unauthorized access to any part of the Platform
  • Scrape, harvest, or collect user information without authorization
  • Use the Platform to send unsolicited communications

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We make no representations about the qualifications, competence, or quality of any healthcare professional listed on the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, Afters, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages related to medical procedures, treatment outcomes, or reliance on information provided through the Platform.

11. Indemnification

You agree to indemnify and hold harmless Afters, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on the Platform with a revised "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
